Abstract
The article is devoted to the research of the legal understanding concept by Oliver W. Holmes, an Associate Justice of the USA throughout 30 years (1902-1932). O. Holmes has taken active part in realisation of reforms of teaching of jurisprudence in Harward. Its scholarly works have entered in so-called "Canon of American Legal Thought of the USA". O. Holmes was the supporter of the conception "Living Constitution". Disclosing of the general principles and values of the Constitution from accepted judgements became basic feature of its approach to interpretation of the American Constitution.
